TERMS AND CONDITIONS

1)     Information on how to enter the ‘Grinders Coffee NZ / Breville Barista Touch Coffee Machine Promotion’  (“Promotion”) form part of these terms and conditions (“Terms and Conditions”). By participating, entrants agree to be bound by these Terms and Conditions.

2)     The promoter is Coca-Cola Europacific Partners N.Z. Limited, 19 Carbine Road, Mt Wellington, Auckland (the “Promoter”).  

Eligibility

3)     Subject to clause 4, entry is open to NZ residents aged 14 years and over who are living in NZ.

4)     Employees of the Promoter and any agency associated with the Promotion, and the immediate families of such employees, are ineligible to enter.

Entry

5)     Entry is open between 12:00am 01/11/2022 and closes 11:59pm 11/11/2022 inclusive (the “Entry Period”). No entries will be accepted outside the Entry Period.

7)     You may enter the promotion multiple times.

Prize

8)     The prize consists of one Breville Barista Touch Coffee Machine, valued at $1,700 and 1kg of Grinders Brazil Coffee Beans (“Prize”).

9)     The Prize is not transferable or redeemable for cash. In the event that the Prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a Prize of equal or greater value.

Winner Selection

10)  The Promoter will select the winner at random from all eligible entries submitted during the Entry Period. The determination as to the winner will be at the Promoter’s sole discretion and no correspondence will be entered into with any entrant.

11)  The draw will take place on xx xx 2022 by random selection from all eligible entries. The winner will be notified by the Promoter via a private Instagram message from the grindercoffeenz Instagram & facebook accounts no later than xx xx 2022.

12)  If the winner cannot be notified for any reason, or does not make contact with the Promoter (via the grinderscoffeenz Instagram or facebook account) within 5 working days of notification, or is found to have otherwise breached any of these Terms and Conditions, his/her selection as a Prize winner may be forfeited and an alternative winner may be selected at the Promoter’s sole discretion. No compensation will be awarded to the forfeiter.

Prize Fulfilment

13)  The Prize will be fulfilled by the Promoter, who will send out the Prize via the most suitable means of transport available. The Promoter will not be responsible or liable for any loss or damage to the Prize that occurs in transit and shall have no liability if the package is not ultimately received by the winner.

General

14)  The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.

15)  The Promoter accepts no responsibility for late or misdirected entries. The Promoter accepts no responsibility for any failure to receive an entry as a direct or indirect result of a technical problem of any kind or any traffic congestion on the Internet or any website. Entries are deemed to be received at the time of receipt into the competition database (the grinderscoffeenz Instagram account), not at the time of transmission by the entrant.

16)  All decisions of the Promoter (including but not limited to selection of the Prize winner) are final and binding – no correspondence will be entered into.

17)  Entrants must comply with all requirements of the Promoter including requirements specified in these Terms and Conditions. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant:

(a)   fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction;

(b)   tampers with or benefits from any tampering with the entry process or the operation of the Promotion;

(c)   submits an entry which in the Promoter's opinion is not in accordance with these Terms and Conditions;

(d)   acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person; or

(e)    in the opinion of Promoter, engages in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.

18)  Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for claims, losses (including loss of opportunity), damages, injuries, costs and/or expenses, whether direct, indirect, special or consequential, suffered, sustained or incurred as a result of, or arising in any way out of, or in any way connected with, the Promotion or any Prize.

19)  If for any reason any aspect of the Promotion is not capable of running as planned, the Promoter reserves the right to, in its sole discretion, cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, at any time. Where it is practical for it to do so, the Promoter will notify entrants of such changes on the grinderscoffeenz Instagram & Facebook pages.

20)  . The winner has rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter.  These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill.  These Terms and Conditions do not, and do not intend to, exclude or limit those statutory rights in any way.  However, to the extent that is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties. 

21)  The Promoter collects personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers or the Prize supplier. Entry is conditional on providing this PI.  The Promoter will use and handle your PI in accordance with its Privacy Policy, which can be viewed at https://www.ccamatil.com/privacy-policy.  The Promoter will take reasonable steps to ensure that the third parties to whom the Promoter discloses PI are bound to protect the privacy of that PI. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the New Zealand Privacy Principles or any other applicable law and how those complaints will be dealt with.

22)  Entrants acknowledge that although the Promotion is conducted via Instagram, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. You agree to completely release Instagram from any and all liability in connection with this Promotion.
